Abstract

A critical issue in dealing with climate change is deciding who has a right to emit carbon dioxide. Originally published in 2007, Allocation in the European Emissions Trading Scheme provided the first in-depth description and analysis of the process by which rights to emit carbon dioxide were created and distributed in the European Union. This was the world's first large-scale experiment with an emission trading system for carbon dioxide and was likely to be copied by others if there was to be a global regime for limiting greenhouse gas emissions. The book comprises contributions from those responsible for putting the allocation into practice in ten representative member states and at the European Commission. The problems encountered in this process, the solutions found, and the choices they made, will be of interest to all who are concerned with climate policy and the use of emissions trading to combat climate change.

Abstract

La décontamination des sols pollués, phénomène longtemps occulté, est devenu une préoccupation majeure des pouvoirs publics et des industries. Les Pays-Bas et la Région flamande ont déjà légiféré dans ce domaine. La République fédérale d'Allemagne est sur le point de le faire. En revanche, l'absence de réglementations spécifiques aux sols contaminés tant en Région bruxelloise qu'en Région wallonne soulève bon nombre d'interrogations. Le 19 mai 1995, le Centre d'étude du droit de l'environnement (CEDRE) et le Séminaire de Recherches en Urbanisme et en Environnement (SERES) ont organisé une conférence aux Facultés universitaires Saint-Louis à Bruxelles sur ce thème. Différents spécialistes ont analysé à la fois la pertinence des instruments juridiques disponibles (polices administratives, responsabilités contractuelle et extra-contractuelle, droit des assurances) et les développements récents en Région flamande et en Région wallonne. Ces rapports sont rassemblés dans le présent ouvrage.

Abstract

The volume focuses on five cases, all of which remain cornerstone trade-environment cases of the WTO. The subject matter of these cases reflects five basic issues in the clash between trade and the environment: public health, air pollution/ozone depletion, food safety, destruction of endangered species, and biosafety. These five issues surface dramatically in international disputes over tobacco, reformulated gasoline, beef growth hormones, commercial fishing methods, and genetically modified organisms. In the second edition of this book, Nathalie Bernasconi-Osterwalder joins the original editors to update and contextualize the five case studies in new introductions to each section. These introductions provide an overview of developments since the first edition, including subsequent related cases. The second edition also includes updated bibliographic materials. In their penetrating analyses of these cases and their vast implications, the authors take into account the entire disciplines of both trade law and environmental law, noting especially the points of friction between the multilateral instruments in each field and the developing jurisprudence of the WTO Dispute Settlement with regard to the exceptions specified in Article XX of the GATT. Abstract

In this publication, a number of recognized practitioners and scholars undertake to explore the realities and the conceptual underpinnings of environmental compliance mechanisms. In a relatively short period of time, such mechanisms were introduced in a wide range of new and existing environmental regimes. Yet, little is known about their function in practice and their implications. This is puzzling when considering, that the new mechanisms considerably depart from traditional patterns of counteraction and dispute settlement. Instead they build on partnership and cooperation and include a wide range of possible reactions, which range from those having coercive power to supportive measures. Quite a number of those mechanisms and their functioning are explained in the publication in order to lay ground for some cross-cutting analysis, which covers inter alia reporting, inspection and monitoring, supportive financial incentives and the interrelationship between compliance mechanisms and the principle of state responsibility and dispute settlement. Finally the role of non-governmental organizations is addressed. Practitioners and scholars in international environmental affairs and international law more generally will benefit significantly from the inside views and thorough reflection as provided for in this book.

Abstract

In today’s fast-paced, fast food world, everyone seems to be eating alone, all the time—whether it’s at their desks or in the car. Even those who find time for a family meal are cut off from the people who grew, harvested, distributed, marketed, and sold the foods on their table. Few ever break bread with anyone outside their own socioeconomic group. So why does the author say that that no one eats alone? Because all of us are affected by the other people in our vast foodscape. We can no longer afford to ignore these human connections as we struggle with dire problems like hunger, obesity, toxic pesticides, antibiotic resistance, depressed rural economies, and low-wage labor. The author argues that building community is the key to healthy, equitable, and sustainable food. While researching this book, the author interviewed more than 250 individuals, from flavorists to Fortune 500 executives, politicians to feedlot managers, low-income families to crop scientists, who play a role in the life of food. Advertising consultants told him of efforts to distance eaters and producers—most food firms don’t want their customers thinking about farm laborers or the people living downstream of processing plants. But he also found stories of people getting together to change their relationship to food and to each other. There are community farms where suburban moms and immigrant families work side by side, reducing social distance as much as food miles. There are entrepreneurs with little capital or credit who are setting up online exchanges to share kitchen space, upending conventional notions of the economy of scale. There are parents and school board members who are working together to improve cafeteria food rather than relying on soda taxes to combat childhood obesity. The author contends that real change only happens when we start acting like citizens first and consumers second. This volume is about becoming better food citizens.
